CUSTOMER AGREES WHEN USING, OR ACCESSING RAINHOST.NET SERVICES THAT THE FOLLOWING TERMS AND CONDITIONS OF THIS POLICY WILL BE MET.

1. Agreement to Terms

By accessing or using the services provided by RainHost (“RainHost”, “we”, “us”, or “our”), operated by Rain IT, you (“Client”, “User”, or “Customer”) agree to comply with and be legally bound by these Terms of Service (“Agreement”).

No purchase or service activation is possible without acceptance of this Agreement.

2. General Use of Services

Users agree to use RainHost services strictly in accordance with:

  • All applicable local, national, and international laws
  • Industry best practices
  • This Terms of Service
  • Our Acceptable Use Policy (AUP)

RainHost reserves the right to cooperate fully with law enforcement authorities or legal requests if any account is suspected of violating applicable laws.

RainHost services may not be used in any way that is unlawful, harmful to society, or against the interests of the state.

3. Limitation of Liability

RainHost and its service providers shall not be liable for:

  • Any direct, indirect, incidental, or consequential damages
  • Data loss
  • Service interruptions
  • Inability to use services

Users are solely responsible for maintaining backups of their data.

4. Acceptable Use Policy (AUP)

4.1 Illegal Activities

RainHost services may not be used for illegal purposes or to support illegal activities. We reserve the right to cooperate with legal authorities in investigating suspected wrongdoing.

4.2 Threats, Harassment, and Personal Data Collection

Users may not:

  • Transmit threatening, abusive, or harassing content
  • Encourage violence or property damage
  • Collect personal data without consent

4.3 Fraud, Forgery, and Impersonation

It is strictly prohibited to:

  • Forge email headers
  • Modify identifying network information
  • Impersonate another person
  • Conduct scams, pyramid schemes, or fraudulent activities

4.4 Network Abuse, Hacking & Malicious Activity

The following are strictly prohibited:

  • Unauthorized access to any system
  • Attempting to breach security measures
  • Denial of Service (DoS) attacks
  • Distribution of malware
  • Digital currency mining without authorization
  • Use of open proxies, mail relays, or anonymous proxies
  • Hosting scripts commonly used for attacks or abuse

Any hacking attempt or unauthorized system access will result in immediate account termination.

4.5 Zero Tolerance for Spam & Abuse

RainHost maintains a strict zero tolerance policy toward:

  • Unsolicited bulk email (spam)
  • Commercial email marketing
  • Automated email campaigns
  • Using RainHost as a mail drop
  • Usenet spam
  • Blacklist-triggering activities

🚨 Immediate Termination for Abuse or Blacklisting

If RainHost receives:

  • Any credible abuse report
  • Any complaint from recognized blacklist databases
  • IP blacklisting notification (including Spamhaus, Outblaze, or similar)
  • Evidence of spam, phishing, malware, or malicious activity

RainHost reserves the absolute right to immediately suspend or permanently terminate the entire customer account, including all active services, without prior notice and without refund, in order to prevent further abuse.

This includes:

  • Shared hosting
  • Reseller accounts
  • VPS
  • Dedicated servers
  • Domains
  • All associated services

RainHost is under no obligation to provide advance warning if continued service may harm network integrity.

Customers whose accounts generate abuse complaints may also be charged administrative fees and must bear all costs incurred by RainHost in responding to abuse reports.

4.6 Prohibited Content

The following content is strictly prohibited:

  • Pornographic or adult content
  • Gambling websites
  • Hardcore adult material
  • Copyright-infringing material
  • Misinformation during crisis situations
  • Content that violates intellectual property rights

4.7 IRC & Bots

Internet Relay Chat (IRC), psyBNC, bots, and similar programs are not permitted on RainHost’s network.

4.8 Third-Party Responsibility

Customers are fully responsible for all activities conducted under their account, including actions by third parties.

5. Payment Terms

5.1 Billing

All services must be paid in advance according to the selected billing cycle. By providing payment information, the customer authorizes RainHost to charge recurring fees automatically.

5.2 Non-Payment

Failure to remit payment:

  • 1 day after due date → Service may be suspended
  • 3 consecutive days after due date → Service may be terminated

Upon termination for non-payment:

  • Services will be reclaimed
  • All data may be permanently deleted
  • RainHost shall not be responsible for data loss

5.3 Payment Reminders

Payment reminders will be sent to the email address on file. It is the customer’s responsibility to:

  • Maintain a valid email address
  • Ensure sufficient funds are available

RainHost is not responsible for undelivered emails due to spam filters or technical issues.

6. Refund Policy

RainHost offers a 72-hour money-back guarantee for first-time shared hosting purchases only.

This guarantee:

  • Applies only to the first hosting order
  • Does not apply to domain registrations
  • Does not apply to VPS or dedicated servers
  • Does not apply to add-ons or overage fees

If a refund was previously granted under this policy, it will not be granted again.

After 72 hours, refunds may be issued only under the terms of our Any-Time Money Back Guarantee, if applicable.

7. Account Cancellation

Customers may cancel services by submitting a cancellation request through the RainHost client area.

  • A minimum of five (5) days notice prior to billing anniversary is required.
  • Cancellation requests via email, phone, or postal mail are not accepted.
  • All outstanding dues must be cleared before cancellation.

Fees are non-refundable unless otherwise stated under the refund policy.

8. Automatic Renewal

All services automatically renew unless cancelled prior to the renewal date.

9. Modifications to Agreement

RainHost reserves the right to modify these Terms of Service at any time, with or without notice. Continued use of services after modifications constitutes acceptance of the updated Terms.

10. Governing Law

This Agreement shall be governed by and interpreted in accordance with applicable laws.
